Shots from the Heart is a competition organised by Advantage West Midland, the government-funded regional development agency for the West Midlands.

USE OF ENTRIES
By entering the competition, you confirm that you have taken the photo yourself, you have not copied it and you have not edited, altered or enhanced it in any way. You further confirm that your Entry does not infringe any third party rights (including intellectual property and privacy rights).
You agree that AWM and third parties authorised on our behalf, may make your Entry available on the Website and in any other media we choose (e.g. we may publish your photo in books and newspapers, display it in buildings, use it in advertising/sponsorship or feature it in a television programme or in online/mobile content). You hereby grant AWM a worldwide, royalty free, irrevocable, perpetual licence to use, display, publish, transmit, copy, make, edit, make derivative works, modify, alter, cut, re-format, sell and sub-license the Entry for all purposes as we may desire (including the purposes noted above). You hereby waive any moral rights (or equivalent rights in any part of the world) you may have in your Entry.
Winners agree to sign a release form in connection with their Entry, if requested by AWM. AWM does not guarantee to use or otherwise make available any Entry.
AWM may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.

"# USE OF ENTRIES

1. By entering the competition, you confirm that you have taken the photo yourself, you have not copied it and you have not edited, altered or enhanced it in any way. You further confirm that your Entry does not infringe any third party rights (including intellectual property and privacy rights).

AWM respects amateur photographer's rights and therefore agrees that you should retain ownership of any copyright that exists in your Entry. However, in order to display your Entry on the Website in a consistent format AWM needs your permission. You therefore agree that AWM and third parties authorised on our behalf, may make your Entry available on the Website and in any other media or technology we choose.

You hereby grant AWM and its supporting partners a non-exclusive, irrevocable, worldwide, royalty-free licence to use, display, publish, transmit, copy, make, edit, make derivative works, modify, alter, cut, re-format and sub-license the Entry for any purpose in connection with the Competition for a period of five years from the date on which the Competition winners are announced, including to:
* display the Entry on the Website and on the websites of supporting organisations solely to promote the Competition;
* include the Entry in a compilation of photographs entered into the Competition;
* include the Entry in any associated exhibitions;
* send the Entry, as part of media promotion of the Competition, to local, regional, national and specialist press for inclusion in such publications;
* sub-license the Entry to the media for use in connection with the competition.

AWM will make every effort to credit you when it uses your Entry.
3. Given that you retain ownership of any copyright in your Entry, AWM will not sell or otherwise transfer ownership in your Entry to third parties. If AWM would like to make use of your Entry in addition to the limited purposes set out above in clause 5(2), we will contact you in writing and negotiate with you. Subject to these negotiations you may be required to sign a release form in connection with your Entry.
4. AWM does not guarantee to use or otherwise make available any Entry. AWM may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory etc. or for any other reason.
